General Charter Terms and Conditions
Payment: Rented boats with complete equipment may only be used after payment has been made (30% upon reservation, the remaining amount before the start of the rental period). The renter (hereinafter referred to as the user) undertakes to provide the lessor with the crew list no later than 4 weeks before the start of the rental period.
Rental fee: The rental fee includes the right to use the boat, but not the fuel costs. The user receives the boat in perfect and clean condition, with a full fuel and water tank, and is expected to return it to the lessor in the same condition at the end of the rental period.
Cancellation of the rental agreement: If the user cancels the rental agreement for any reason, they are free to find another user who will assume their rights and obligations. For this purpose, prior approval from the lessor is required. In case no replacement is found, the following amounts are due to the lessor:
Any delay in payment will be considered as cancellation of the rental agreement, and the lessor reserves all rights mentioned above.
Security deposit: The charterer takes out liability and comprehensive insurance with a deductible for the vessel. The charterer is responsible for damages up to 2,000 EUR for sport boats and up to 3,000 EUR for BAVARIA S29. Before the start of the charter, the charterer is required to deposit a security amount of 500 EUR - 1,500 EUR with the charterer. Once the charterer returns the boat in perfect condition, the deposited amount will be refunded. If there are any damages to the boat or its equipment, or if any equipment is missing, the damaged or missing parts will be charged.
Takeover and handover of the boat:
A) The user takes over the fully equipped boat, with a full fuel tank, in perfect condition, and is expected to return it to the lessor in the same condition. In case of damage to the boat, the user is responsible for all resulting costs according to Article 4 of the General Charter Terms and Conditions (AB). In case of damage to the inventory due to the user's negligence or loss of one or more equipment items, the user bears the actual (simple) costs, which will be deducted from the security deposit. The crew and their belongings are not insured, and the user is advised to arrange appropriate insurance contracts.
B) The user has no right to a reduction in the rental fee due to hidden defects of the boat and equipment that were not known to the lessor or occurred after the boat handover by the user.
C) In the event of an accident, the user may arrange for necessary repairs after prior consultation with the lessor. The user undertakes to report the accident, in which other watercraft may also be involved, to the relevant port authority and create a report for the insurance carrier (accident sequence and damage assessment). The user must immediately notify the lessor of the accident. If the user fails to fulfill their obligations, they will be liable for all damages incurred by the lessor as a result of the accident.
D) If continuing the voyage and adhering to the return deadlines become impossible for any reason, the user must inform the lessor for further instructions.
E) In the event of a weather-related delay in returning the boat, the user is liable for all damages caused by the delay to the lessor. For this reason, the user is recommended to plan accordingly.
F) The user undertakes to return the boat to the lessor on time and at the agreed location. In case of non-compliance, the user agrees to pay the full daily rental fee for a delay of up to 3 hours, and double the daily rental fee for a delay of more than 3 hours, plus any damages caused by the delay. IF THE CHARTERER DOES NOT RETURN THE BOAT WITH A FULL FUEL TANK, THEY ARE OBLIGATED TO PAY THE TOTAL COST OF REFUELING THE FUEL TANK + 30.00 EUR PENALTY.
Obligations of the lessor: The lessor undertakes to hand over the boat to the user at the agreed location and time. If the lessor is unable to provide the user with a comparable or better boat within 24 hours after the agreed deadline, the user has the right to withdraw from the rental agreement or receive compensation in the amount of the agreed daily rental fee for each day they could not use the rented boat. All other claims arising from this are excluded. The lessor reserves the right to cancel the contract no later than 7 days before the start of the charter. In this case, the lessor shall refund the paid rental fee without interest to the user.
Obligations of the user:
A) The user undertakes to handle the boat with care and comply with all applicable regulations. In the event of a violation of official regulations, laws, and orders, the user is solely responsible. The user undertakes to immediately inform the lessor of the disappearance or inoperability of the boat, as well as any impoundment or confiscation by the relevant authorities.
B) The user must possess a boating license and permission to use/operate a radio device (applies only if the customer rents the BAVARIA 28 boat). The lessor is entitled to prohibit departure if they determine that the user lacks sufficient knowledge and skills (e.g., in connection with prevailing weather conditions). In this case, the user shall make efforts to acquire the necessary knowledge with the help of a skipper. The user is not allowed to sublet the boat or lend it to third parties, participate in regattas, or use the boat for commercial purposes and professional fishing. The user undertakes to sail exclusively within the Croatian territory and only at night under good weather conditions. They also undertake to handle the boat, inventory, and equipment with care.
C) The user must appoint a skipper before the start of the rental period, unless they intend to fulfill this role themselves. The skipper shares responsibility with the lessor.
D) The user must check the oil level in the engine every day. The user is solely responsible for any damages caused by oil shortage, as they are not covered by the insurance policy. If there is damage to the underwater parts of the boat, the entire boat will be inspected at the user's expense.
Complaints: The lessor is only liable for complaints made at the time of boat handover. Complaints must be made in writing and signed by the lessor or their representative, as well as the user, to be valid.
Jurisdiction: The parties will make every effort to resolve any disputes amicably. Otherwise, the jurisdiction of the court in the lessor's registered office is agreed upon.
